New York State Bar Association Issues Statement About Independence of The Courts

Sherry Levin Wallach, president of the New York State Bar Association, issued the following statement about the separation of powers:

“The New York State Bar Association is a staunch advocate for access to justice for all, adherence to the rule of law, and fairness of process. We also recognize that none of these worthy goals can be fully realized without separate, independent, and co-equal branches of government. To maintain their independence, it is necessary for the courts to be allowed to manage in accordance with their constitutional obligations.

“We also strongly believe that judges must be able to decide cases and issue rulings free of outside influence. Each branch of our state government must carry out its duties respectful of the other branches. That is the essence of the system of checks and balances that is the underpinning of our democracy.”
