This program, featuring speakers from both common law and civil law jurisdictions, will discuss the process for obtaining foreign discovery under the Hague Evidence Convention or by letters rogatory, and other tools available in key foreign countries.

Esteemed Faculty:
David Rosenthal is one of the leading Swiss experts in the field of Data and Technology law. His background is atypical: he graduated in law at the University of Basel in 1997 and worked as a software developer, legal advisor and journalist before joining one of Switzerland’s top law firms, where he built up and managed the data protection department, among other things. David Rosenthal is the principal author of one of the leading commentaries on data protection law. In addition to data law (including GDPR) he advises projects in the IT and digital business sector and represents clients in technology-related arbitration proceedings. His clients include major international corporations as well as Swiss SMEs, start-ups and public authorities; he is regarded as pragmatic, efficient and solution-oriented. Rosenthal also has over 15 years of experience in conducting internal investigations and cross-border e-Discovery projects. He is Secretary of the Association for Corporate Data Protection (VUD) and the Cross-border eDiscovery Privacy & Investigations Association (CeDIV), as well as lecturer at the ETH Zurich and the University of Basel.
Gretta Walters is a Partner at Chaffetz Lindsey LLP in New York City. Her experience spans a broad range of commercial and investment disputes in domestic and international arbitration and in litigation in state and federal courts. Gretta also sits as arbitrator, is an adjunct professor at New York University School of Law and was recently elected to the AAA-ICDR Council. She was formerly Legal Counsel at the Arbitration Institute of the Stockholm Chamber of Commerce and holds an LLM in International Commercial Arbitration from Stockholm University.
Sam Roberts is a Partner at Cooke, Young & Keidan in London. Sam’s core practice is technology, banking and fraud. In technology, his experience includes crypto disputes, software licensing and development claims, and breach of warranty claims in an M&A context. His banking experience is broad and includes claims for negligent investment advice, benchmark manipulation and other market abuse, intercepted payments, guarantees, loans and derivatives. Sam also has deep and practical experience of acting on applications for injunctive relief. Sam co-founded and runs the Tech Disputes Network, a London-based group for professionals involved and interested in technology disputes.
Samaneh Hosseini is a Partner in the Litigation & Dispute Resolution Group of Stikeman Elliott LLP. Her practice focuses on commercial litigation with an emphasis on complex contract disputes, class actions, securities litigation, shareholder disputes and product liability. Sam has significant experience defending a variety of domestic and multi-jurisdictional class actions including cases involving securities law, product liability, franchise law, competition law and consumer protection. Sam regularly advises companies and their directors and officers in matters involving allegations of corporate misconduct including internal and regulatory investigations and has expertise in commercial arbitration.
Wouter de Clerck is a specialist in complex, cross-border disputes, to be settled in arbitration or before the national courts. Most of his clients are active in the technology, energy or mining sector. Specialisation The disputes in which Wouter assists his clients often involve commercial contracts for the supply of services or goods (incl. energy, oil and natural gas), M&A agreements or joint venture agreements. Wouter has experience of arbitration before various institutions (NAI, ICC, PCA, LCIA and SIAC) as well as of ad hoc arbitration (UNCITRAL). Wouter furthermore regularly conducts proceedings before the national courts in matters related to arbitration such as international jurisdiction or recognition and enforcement of arbitral awards. Wouter also sits as arbitrator.
